DeSoto adopts the 2021 IRC/IFC requiring hardwired, interconnected smoke alarms with battery backup in every bedroom, outside each sleeping area, and on every level of a home. Rental properties must also provide CO alarms near fuel-burning appliances.
Under the 2021 International Residential Code and IFC Section 907, as adopted in DeSoto Chapter 18 and Chapter 38, all residential dwellings constructed or substantially renovated after adoption must have smoke alarms: inside each sleeping room, outside each sleeping area in the immediate vicinity of bedrooms, and on every story. Alarms must be hardwired with battery backup and interconnected so all sound simultaneously. Existing homes must at minimum have battery or 10-year sealed battery alarms in these locations. Landlords are required under Tex. Property Code Β§92.255 to install and test alarms at move-in; tenants may sue for non-compliance. CO alarms are required within 10 feet of any sleeping area in homes with fuel-burning appliances or attached garages.
Class C citation $100-$500; Tex. Property Code private cause of action with statutory damages up to $500 plus one month's rent.
