Full Breakdown

Buncombe County's open-burning rules, part of the county fire prevention ordinance, treat different kinds of outdoor fire differently. A recreational fire, the small contained fire people build for warmth or cooking in a backyard fire pit, cannot be conducted within 25 feet of a structure or combustible material, and anything that could let the fire spread within that 25 feet has to be cleared away before it is lit, under Sec. 30-49(i). That is a lighter standard than a bonfire, which needs a full 50-foot clearance from any structure plus a permit and inspection from the fire code official before it happens, under Sec.

30-49(h). A portable outdoor fireplace, the manufactured kind sold for patios, only needs 15 feet of clearance and manufacturer-instruction compliance, and is exempt from that distance rule entirely at one- and two-family dwellings, under Sec. 30-49(j). Every category, including recreational fires, must be constantly attended until fully extinguished and kept near a portable fire extinguisher rated at least 4-A, or other on-site equipment such as dirt, sand, a water barrel, garden hose, or water container, under Sec. 30-49(k). All open burning, including recreational fires, must also comply with the Asheville-Buncombe Air Quality Agency Code, and the county fire marshal can declare a countywide open-burn ban whenever atmospheric conditions or local circumstances make fires hazardous, under Sec. 30-49(a)-(b). State law and any conflicting state fire code provision override this section where the two conflict.

Violations & Fines

Violating any part of the open-burning section, including the recreational-fire setback or attendance requirement, can bring a civil penalty of up to $500 per violation, and separately constitutes a class 3 misdemeanor under state law, N.C. Gen. Stat. Section 14-4, punishable by up to $500 or up to 30 days in jail, under Sec. 30-49(l). These penalties stack on top of anything imposed by state or federal agencies.

Frequently Asked Questions

How far from my house does a fire pit need to be in unincorporated Buncombe County?
At least 25 feet from your house or any other structure or combustible material, and anything that could carry the fire toward that 25-foot zone must be cleared away before lighting it, under Sec. 30-49(i). That is a shorter distance than the 50 feet required for a bonfire.
Do I need a permit for a backyard fire pit?
No permit is required for a recreational fire itself under Sec. 30-49(i). A bonfire, by contrast, does need a permit and inspection from the fire code official under Sec. 30-49(h), and a portable outdoor fireplace needs none at a one- or two-family home under Sec. 30-49(j).
What do I need to keep on hand while a fire pit is burning?
The fire must be constantly attended until it is fully out, and you need at least one portable fire extinguisher rated 4-A, or another approved option like dirt, sand, a water barrel, garden hose, or water container, ready for immediate use, under Sec. 30-49(k).
Can the county ban all outdoor fires temporarily?
Yes. The fire marshal has the authority to issue a countywide open-burn ban, covering recreational fires along with bonfires and other open burning, whenever atmospheric conditions or local circumstances make fires hazardous, under Sec. 30-49(b).
