Tulare County Ordinance Code Part 4, Chapter 5 (Safety Regulations) makes it unlawful to sell, offer for sale, or display for sale any 'Safe and Sane' fireworks within the unincorporated Local Responsibility Area (LRA) without first obtaining a permit from the County Fire Chief or designee. Use of fireworks, including safe-and-sane, is unlawful in the unincorporated LRA except during the limited statutory window leading up to and including July 4, with all fireworks unlawful from July 5 through noon on June 28 of the following year. In the foothill and mountain regions (State Responsibility Area), all fireworks - including safe-and-sane - are prohibited at all times. Maps of the LRA are posted at every County Fire station. Statewide, California Health & Safety Code sections 12500-12728 bans 'dangerous fireworks' (aerial shells, rockets, mortars, firecrackers) for unlicensed users; HSC section 12700 makes possession a misdemeanor with state fines from $1,000 (under 25 lbs) up to $100,000 (over 5,000 lbs). Incorporated cities like Visalia, Tulare, and Porterville set their own city rules - several Tulare County cities ban fireworks entirely. Using fireworks in the foothill/mountain region, using safe-and-sane fireworks outside the permitted window in the LRA, or selling fireworks without a Fire Chief permit can result in administrative citations from Tulare County Fire, seizure of fireworks, and misdemeanor prosecution under HSC section 12700 with state fines starting at $1,000 and reaching $100,000 for large quantities of dangerous fireworks. The person responsible for an escaped fire is also liable for suppression costs under Public Resources Code section 4435.
