Montgomery County Code Β§22-70 is more restrictive than Maryland state law. While Maryland state law allows 'ground and hand-held sparkling devices' (sparklers), Montgomery County bans all fireworks including sparklers. Only snap-and-pop noise makers, snakes, and party poppers are exempt. It is unlawful to manufacture, possess, store, sell, discharge, use, or explode any fireworks. Possession of fireworks for more than 8 hours requires a State Fire Marshal permit. Professional displays require a permit from the State Fire Marshal. Violations subject to up to $1,000 fine and/or 6 months imprisonment.
