Consumer fireworks are legal in Orange County only on July 4, December 31, and January 1 under FL Β§791.08. On all other days only sparklers and novelties are allowed; aerial and explosive fireworks are prohibited.
Florida Statute Β§791.08 preempts local bans on the three designated holidays of Independence Day, New Year's Eve, and New Year's Day. Outside those dates, Orange County Code prohibits the discharge of consumer fireworks that fly or explode, including bottle rockets, Roman candles, firecrackers, and mortars. Sparklers, fountains, smoke devices, and snappers listed on the FL State Fire Marshal approved novelty list remain legal year-round. Orange County Fire Rescue and the Sheriff respond to complaints, and unincorporated neighborhoods near Orlando, Pine Hills, and Apopka see the heaviest enforcement activity. Fireworks are prohibited at all times in county parks and on conservation lands.
First offense discharge outside holidays: civil citation up to $500. Reckless use causing injury or fire: second-degree misdemeanor under FL Β§791.06, up to 60 days jail and $500 fine.
