Under Florida Statute Chapter 791, as amended by HB 65 (2020), consumers in Orlando may legally use aerial and explosive fireworks (firecrackers, bottle rockets, Roman candles, mortars) on three holidays: July 4 (Independence Day), December 31 (New Year Eve), and January 1 (New Year Day). Outside those dates, only state-approved sparklers and novelties listed on the Florida State Fire Marshal sparkler list may be used. Local nuisance, noise, and trespass rules still apply, and Orlando Fire Department prohibits fireworks during burn bans.
Florida Statute Chapter 791 governs fireworks statewide. HB 65 (2020) created an exemption in section 791.08 allowing the use of fireworks (otherwise restricted to agricultural and industrial uses) by consumers on three designated holidays each year: July 4, December 31, and January 1. On all other days, only items on the Florida State Fire Marshal approved sparklers and novelties list may be used legally; this excludes firecrackers, bottle rockets, Roman candles, mortars, and aerial repeaters. Orlando enforces these state rules through its fire and code enforcement divisions and may issue citations for illegal use, particularly when accompanied by noise complaints under City Code Chapter 42 or fire-safety violations. Use of fireworks of any kind is prohibited during local or county burn bans and during red-flag warnings issued by the Florida Forest Service. Fireworks within 200 feet of fireworks storage, gas stations, or on public property is prohibited. Selling consumer fireworks requires a permit and signage warning that consumer use is limited to the three holidays.
