Sparklers approved by the State Fire Marshal are legal year-round. Selling fireworks from a tent in Brandon requires a Hillsborough County Tent & Sparkler Permit from the Fire Marshal. During a declared burn ban (frequent in spring 2026), the County Administrator's Executive Order overrides the three statutory holiday exceptions and prohibits all fireworks and sparklers.
Possession or discharge during a burn ban is a misdemeanor; illegal sale carries up to $1,000 fine per Florida Statute §791.06.
