Consumer fireworks are legal statewide in Georgia. Any day you may use them from 10:00 a.m. to 11:59 p.m., extended on July 3, July 4, New Year's Eve and to 1:00 a.m. on January 1. Clayton County may regulate the time through its noise ordinance but cannot ban them.
Georgia legalized consumer fireworks under O.C.G.A. Title 25, Chapter 10. State law, not Clayton County, sets when they may be used: 10:00 a.m. to 11:59 p.m. on any day, with protected windows on the last weekend of May, July 3, July 4, Labor Day, December 31, and until 1:00 a.m. on January 1. Local governments may enforce a general noise ordinance to restrict use outside those protected holiday hours, but they may not prohibit fireworks outright. Use is banned within any prohibited distance of certain facilities and by anyone under 18.
Using fireworks outside permitted hours or in violation of a local noise ordinance is a misdemeanor; illegal sales and underage sales carry separate penalties under O.C.G.A. 25-10.
