Wis. Stat. Β§167.10 requires a user's permit for nearly all consumer fireworks (firecrackers, bottle rockets, Roman candles, mortars, aerial repeaters). Permits issued by the mayor, village president, or town chairperson β or designee β where use will occur. Sparklers under 36 inches, snakes, smoke bombs, caps, model rocket engines, and small DOT 1.4 cones/fountains are exempt.
Under Wis. Stat. Β§167.10(1), 'fireworks' means anything manufactured for exploding, emitting sparks, or combustion that has no other common use, but excludes: sparklers on a wire or wood stick not exceeding 36 inches, toy snakes without mercury, smoke devices with less than 1/4 grain of explosive mixture, caps with less than 1/4 grain per cap, model rocket engines, and certain DOT Division 1.4 fountains and cones. Β§167.10(3) requires a user's permit for all non-exempt fireworks, issued by the mayor of a city, village president, or town chair (or designee) where use will occur β minors cannot receive permits. Outagamie County itself does not issue user's permits; in Appleton, Kaukauna, Seymour, and each town and village within the county, the local executive issues permits. Local ordinances may further restrict items state law permits.
