The North County Fire Authority, which serves Daly City, Brisbane, and Pacifica, states plainly that 'the City of Brisbane and City of Daly City do not allow or permit the use of fireworks' -- unlike neighboring Pacifica, which allows safe-and-sane fireworks from inspected booths. Under California's State Fireworks Law (Health and Safety Code sections 12500 et seq.), safe-and-sane fireworks are legal only where a local jurisdiction permits them; Daly City does not. Public pyrotechnic displays remain possible only through a permit investigated by the fire chief and approved by the city council under section 8.24.080.
The city states that fireworks violators 'can expect a ticket with fines up to $1,000 and in some cases will be booked into County jail.' Violations of the adopted fire code are misdemeanors punishable under Municipal Code section 1.12.010, and NCFA warns that fines and penalties for distribution or use of illegal fireworks have increased and will be strictly enforced.
