In unincorporated El Paso County, these same state rules apply. However, El Paso County is in a high fire-risk Wildland Urban Interface (WUI) area, and the Board of County Commissioners routinely issues fire restrictions or Stage 1/Stage 2 bans during dry summer months that prohibit all open burning including fireworks. Use of illegal (aerial) fireworks: misdemeanor under state law, fines up to $1,000. Violations during a burn ban can result in additional citations and liability for fire suppression costs.
