Flint regulates consumer fireworks under the Michigan Fireworks Safety Act (MCL 28.451 et seq., as amended by PA 257 of 2018), which preempts a full local ban but lets cities restrict use to the day before, day of, and day after national holidays. Fireworks may be ignited from 11:00 a.m. to 11:45 p.m. (12:30 a.m. for July 5 and December 31) on those windows only.
Michigan's Fireworks Safety Act (PA 256 of 2011, MCL 28.451+) legalized consumer-grade aerial fireworks statewide but, as amended by PA 257 of 2018, gives local governments broad authority to restrict use to specific holiday windows. In a city the size of Flint, consumer fireworks may be ignited only on: December 31 from 11:00 a.m. to 1:00 a.m. on January 1; the Saturday and Sunday immediately before Memorial Day from 11:00 a.m. to 11:45 p.m.; June 29 to July 4 from 11:00 a.m. to 11:45 p.m.; July 5 if it falls on a Friday or Saturday from 11:00 a.m. to 11:45 p.m.; and the Saturday and Sunday immediately before Labor Day from 11:00 a.m. to 11:45 p.m. Igniting consumer fireworks on public property, school property, church property, or another person's property without express permission is prohibited statewide. Sale to anyone under 18 is prohibited. Civil fines under the Act run up to $1,000 per violation. The Flint Police Department and Fire Marshal enforce the restrictions, and complaints typically spike around July 4.
Igniting consumer fireworks outside the permitted holiday windows, after the 11:45 p.m. (or 1:00 a.m. New Year) cutoff, or on public, school, church, or another person's property without permission, violates MCL 28.457. The state Act authorizes civil fines up to $1,000 per violation. Local officers may seize illegal fireworks and refer commercial violations for additional prosecution.
