Flint Code Section 31-72(b)(10) prohibits operating any mechanically powered saw, drill, sander, grinder, lawn or garden tool, snowblower, or similar device outdoors in residential areas during nighttime (9:00 p.m. to 8:00 a.m.) in a manner causing a noise disturbance across a residential real property boundary, except in an emergency. There is no gas-blower ban.
Flint regulates leaf blowers and other yard equipment through Section 31-72(b)(10) of Chapter 31 Article II. The provision applies to 'any mechanically powered saw, drill, sander, grinder, lawn or garden tool, snowblower, or similar device used outdoors in residential areas during the nighttime so as to cause a noise disturbance across a residential real property boundary, except in an emergency.' NIGHTTIME is 9:00 p.m. to 8:00 a.m. under Section 31-71. Daytime operation is further governed by Section 31-77(g), which exempts 'the operation of domestic tools such as lawn mowers, snowblowers, edgers and the like, when such tools are operated in a manner and frequency that is normal and customary in the community.' Gas-powered leaf blowers are NOT separately banned in Flint, unlike Washington DC or several California cities. Federal preemption of small-engine emissions runs through EPA 40 CFR Part 90, but does not preempt local time-of-day rules.
Section 31-78(a): up to $1,500 fine, 90 days jail, or both for nighttime operation breaching a residential boundary. The Section 31-78(b) first-offense $25 waiver at the District Court Clerk is available. Section 31-77(g) defense (normal and customary daytime operation) is unavailable for nighttime use under Section 31-72(b)(10), which is independent of dBA measurement.
