Vehicle noise in Flint runs through three layers. Section 31-72(b)(1)(b) of the City Code prohibits sound devices in a vehicle creating a disturbance at 50 feet on a public right-of-way. Section 31-72(b)(6) bans vehicle/motorboat repair or testing causing a residential boundary disturbance. State law MCL 257.707c preempts municipal motor vehicle noise standards and sets the controlling 86/90 dBA caps at 50 feet.
Flint's vehicle-noise framework is hybrid. Section 31-72(b)(1)(b) bans operating any radio, amplifier, or similar device 'in such a manner as to create a noise disturbance at fifty (50) feet (15 meters) from such device, when operated in or on a motor vehicle on a public right-of-way or public space, or in a boat on public waters.' Section 31-72(b)(6) reaches vehicle and motorboat repair, rebuilding, modification, or testing that creates a residential boundary disturbance. Section 31-72(b)(9) caps motorboat sound at 85 dBA at 50 feet or the nearest shoreline. CRITICAL: Section 31-77(d) exempts motor vehicles whose noise levels are regulated by Michigan Public Act 73 of 1978 (now codified at MCL 257.707c et seq.) and the Flint Motor Vehicle/Traffic Code. MCL 257.707c sets the controlling caps: 82 dBA (motorcycle, speed limit 35 mph or less), 86 dBA (motorcycle, over 35 mph), 86 dBA (other vehicle, 35 mph or less) at 50 feet. Defective exhaust, removed muffler, cutouts, bypasses, and amplifiers are prohibited under MCL 257.707c. Civil infraction, fine up to $100 under MCL 257.707c.
Two penalty tracks. Local Section 31-78(a): up to $1,500 fine, 90 days jail, or both for Section 31-72(b)(1)(b), (b)(6), and (b)(9) violations not preempted by state vehicle code. State MCL 257.707c muffler/exhaust violation: civil infraction, fine up to $100, no jail. Each violation independently chargeable; equipment-removal repair tickets may also issue under state law.
