All fireworks - including California State Fire Marshal-classified 'Safe and Sane' devices - are illegal to possess, sell, use, or discharge anywhere in unincorporated El Dorado County. The prohibition is set by El Dorado County Code Chapter 8.08 (Fire Prevention) and is reinforced by California Health & Safety Code Section 12541, which leaves the regulation of fireworks to local ordinance.
El Dorado County Code Chapter 8.08 prohibits the sale, possession, storage, use, or discharge of any fireworks within the unincorporated territory of the county. The ban covers everything from bottle rockets and aerial shells (dangerous fireworks under California Health & Safety Code Section 12505) to sparklers, fountains, and ground spinners (Safe and Sane fireworks under HSC Section 12529). The El Dorado County Fire Protection District and Cal Fire Amador-El Dorado Unit both publicly confirm that 'All fireworks are illegal in El Dorado County, including Safe and Sane.' California Health & Safety Code Section 12541 expressly preserves local authority: 'Nothing in this part authorizes the sale, use, or discharge of fireworks in any city, county, or city and county in which the sale, use, or discharge is otherwise prohibited or regulated by law or ordinance.' The only exception is public displays conducted by a State Fire Marshal-licensed pyrotechnic operator under a permit issued in advance.
Possession or use of fireworks in El Dorado County can be cited as a misdemeanor under HSC Section 12700 et seq. Per Cal Fire, possession or transport of illegal dangerous fireworks can result in fines up to $50,000 and up to one year in jail under California Health & Safety Code Section 12677. Suppression and investigation costs may also be recovered from the responsible party under California Health & Safety Code Section 13009 if the fireworks cause a fire.
