Possession of any fireworks, including state-approved "Safe and Sane" fireworks, is illegal in all unincorporated areas of San Bernardino County, according to San Bernardino County Fire. Aerial and exploding fireworks are banned statewide under California Health & Safety Code 12500 et seq.
San Bernardino County Fire Protection District states that the possession of any type of fireworks, including "Safe and Sane" fireworks, is illegal in all unincorporated areas of the county. This is stricter than California state law, which generally allows State Fire Marshal-approved "Safe and Sane" fireworks unless a local ordinance prohibits them. Under California Health & Safety Code section 12677, possessing dangerous fireworks (firecrackers, skyrockets, aerial shells, anything that explodes, shoots into the air, or moves along the ground) without a permit is a misdemeanor; these dangerous fireworks are banned everywhere in California. "Safe and Sane" fireworks are only sold and used legally in a handful of incorporated San Bernardino County cities that license them: County Fire lists Adelanto, Chino, Colton, Needles, and Rialto, plus specific locations within Fontana, Grand Terrace, and San Bernardino. Outside those city limits, in the unincorporated county, all consumer fireworks are prohibited. County Fire warns that if a fire is caused by fireworks, those responsible may face criminal charges and be held liable for damages. Property owners can also be cited if fireworks are possessed, stored, or used on their property. Given extreme wildfire risk in the San Bernardino Mountains and foothills, enforcement is aggressive around July 4.
San Bernardino County Fire states fines of up to $1,250 for a first offense, with the possibility of arrest. Property owners may be cited if fireworks are possessed, stored, or used on their property. Causing a fire with fireworks can bring criminal charges and civil liability for damages. Possession of dangerous fireworks is a misdemeanor under California Health & Safety Code 12677.
