Rialto is one of the few San Bernardino County cities that allows state-approved safe and sane fireworks. Municipal Code section 5.20.010 limits sale and discharge to the window from noon June 28 through midnight July 6, and all dangerous fireworks are banned.
Rialto Municipal Code Chapter 5.20 (Fireworks) adopts the state framework in Health and Safety Code sections 12500 et seq. Section 5.20.005 defines safe and sane fireworks by reference to Health and Safety Code section 12529 (items carrying the State Fire Marshal seal) and dangerous fireworks by reference to section 12505 (firecrackers, skyrockets, roman candles, chasers, and similar exploding or aerial devices). Section 5.20.010 allows safe and sane fireworks to be sold or discharged only between noon on June 28 and midnight on July 6 each year, and section 5.20.070(D) cuts off retail sales at midnight on July 4. Section 5.20.120 makes it unlawful to possess or discharge dangerous or exempt fireworks anywhere in the city, and prohibits igniting even safe and sane fireworks within ten feet of a residence or other inhabited structure. Sales are limited to temporary stands run by Rialto-based nonprofits; the city council has capped the number of stand licenses at eighteen per year (section 5.20.050). Per the county, fines for illegal fireworks in the region run up to $1,250 for a first offense. Separately, Rialto Ordinance No. 1706 bans sky lanterns outright (amended California Fire Code section 308.1.7).
Under RMC 5.20.130, discharging or selling safe and sane fireworks outside the allowed window, or within ten feet of a residence, is an infraction. Igniting or possessing dangerous or exempt fireworks is a misdemeanor. Property owners who allow fireworks violations on their property face strict-liability misdemeanor charges unless they immediately report the violation to the Rialto Police Department.
