All fireworks — including 'Safe and Sane' state-approved fireworks — are illegal to possess, sell, use, or discharge within the City of Rialto. Only public displays by licensed pyrotechnic operators with a Rialto Fire permit are allowed. California Health & Safety Code §12500 et seq. classifies all non-Safe-and-Sane fireworks as 'dangerous fireworks' statewide, and Rialto adds a local ban on Safe-and-Sane.
Rialto Mun. Code Title 8 (Health and Sanitation) and Title 15 Ch. 15.28 incorporate the California Fire Code §5601, which prohibits manufacture, sale, possession, and discharge of fireworks except as specifically permitted. Under Cal. Health & Safety Code §12677, cities may ban Safe-and-Sane fireworks even when state law would otherwise allow them; Rialto exercises this authority. Aerial fireworks (skyrockets, firecrackers, M-80s, mortars, bottle rockets) are 'dangerous fireworks' under HSC §12505 and are illegal statewide regardless of city rules. Discharge of fireworks during red-flag fire-weather warnings or in any wildland-urban-interface area near the Cajon Pass/foothill overlay is an enhanced offense. The annual 4th of July city celebration at Jerry Eaves Park is the legal public-display option.
Possession or discharge of dangerous fireworks: misdemeanor under HSC §12700, up to $1,000 and/or 1 year jail. Local Safe-and-Sane discharge: infraction up to $1,000 per HSC §12557 administrative fines. Rialto also imposes administrative citations and can hold a host property owner liable.
