San Bernardino, CA Fire Regulations: Fireworks (2026)

The City of San Bernardino prohibits the sale, possession, and use of all fireworks within city limits under San Bernardino Municipal Code Chapter 8.60. Unlike some neighboring jurisdictions, San Bernardino does not permit State Fire Marshal approved Safe and Sane fireworks during the Fourth of July window. The prohibition covers fountains, sparklers, spinners, firecrackers, bottle rockets, aerial repeaters, mortars, and any device that emits sparks, flame, smoke, or sound for entertainment. California Health and Safety Code Section 12500 classifies aerial and exploding devices as dangerous fireworks, which are banned statewide regardless of local rules. San Bernardino adopted an aggressive administrative citation schedule in response to repeated wildland fires and noise complaints, with first-offense fines set at 1,250 dollars for possession and escalating to 3,000 dollars for a third offense within one year. A social host liability provision holds property owners and tenants responsible for illegal fireworks used by guests on their property, even if the owner did not personally discharge the device. The San Bernardino Police Department operates an enhanced fireworks enforcement team from mid-June through July 5, including an online reporting tool. Licensed pyrotechnic displays conducted by a California licensed operator with a city permit are the only fireworks legally allowed within city limits.
