Massachusetts bans private citizens from selling, possessing, or using fireworks of any kind under M.G.L. c. 148, section 39. The statute makes it unlawful to 'sell, or keep or offer for sale, or have in his possession, or under his control, or use, or explode, or cause to explode' any firework, defined to include firecrackers, cherry bombs, sparklers, rockets, Roman candles, blank cartridges, toy cannons, and similar items containing any explosive or flammable compound. The ban applies even to fireworks bought legally in another state and brought into Massachusetts. Lowell reinforces this locally through City Code section 155-17, which states that no person shall sell, possess, or use fireworks within the City, except that a person holding a permit issued under M.G.L. c. 148, section 10A may purchase and display fireworks in accordance with Chapter 148 and Department of Public Safety regulations. Only licensed professional pyrotechnicians may conduct supervised public displays under a permit granted under M.G.L. c. 148, section 39A.
Under M.G.L. c. 148, section 39, selling fireworks is punishable by a fine of $100 to $1,000 or up to one year imprisonment, while possession or use carries a fine of $10 to $100, and the fireworks are seized and forfeited to the Commonwealth. Lowell City Code section 155-17 adds a city fine of $500 for each violation.
