Waukesha County, WI Fire Regulations: Fireworks (2026)

Waukesha County regulates fireworks through two separate but overlapping provisions. Sec. 13-102, the county's "State Offenses Adopted" ordinance, incorporates the definitions and prohibitions of Wis. 10(1), governing possession, use or distribution of fireworks, and makes it an enumerated county offense; subsection (d)1 sets the local forfeiture penalty at not less than $25 nor more than $100 for a violation, a fixed county-level range that applies instead of the state statute's own penalty language, since Sec. 13-102(c) adopts only the conduct the statute describes and excludes its penalty provisions.

Because this is a countywide ordinance rather than a park rule, it reaches private property and roadways throughout the unincorporated towns, not just county-owned land. Inside the park system specifically, Sec. 14-156(a)1 layers on a second, park-only ban: no person may possess or discharge any fireworks regulated by Wis. 10(1) in a park, except for fireworks exhibitions conducted under the direction or with the permission of the director of parks and land use or an authorized agent. Sec. 14-156(a) also separately bars discharging guns, air guns, bows and other projectile weapons in parks except on designated ranges or for authorized hunting, and Sec. 14-156(c) confines all park fires to designated fireplaces, fire rings or permanent grills.
