Consumer fireworks are legal in Omaha during limited windows: July 2β4 (noonβ11 PM) and New Year's Eve (5 PMβ1 AM). Fines range from $300β$500.
Despite Nebraska state law (Neb. Rev. Stat. Β§28-1241 et seq.) permitting consumer fireworks statewide, Omaha regulates their discharge to specific dates and times. Within Omaha city limits, fireworks may only be discharged on July 2, 3, and 4 from 12 PM to 11 PM, and on New Year's Eve from 5 PM until 1 AM on New Year's Day. Only consumer-grade fireworks are permitted β display-grade is prohibited. The Omaha Fire Department enforces fireworks laws. Vendors must also obtain permits and comply with state Fire Marshal requirements, with retail sales limited to June 25βJuly 4 and December 31.
A first offense for illegal fireworks use in Omaha can result in a $300 fine; repeat offenses can result in a $500 fine.
