Consumer fireworks (firecrackers, bottle rockets, Roman candles, aerial shells, mortars) are illegal in Peoria and throughout Illinois under the Illinois Pyrotechnic Use Act, 425 ILCS 35/. Illinois is one of the most restrictive states for consumer fireworks. The Pyrotechnic Use Act (425 ILCS 35/2) makes it 'unlawful for any person, firm, co-partnership, or corporation to knowingly possess, offer for sale, expose for sale, sell at retail, or use or explode any display fireworks, flame effects, or consumer fireworks' except as authorized for licensed displays. Consumer fireworks are defined by reference to U.S. Consumer Product Safety Commission classifications 16 CFR 1500/1507 and DOT classifications UN0336/UN0337 β covering essentially all aerial and exploding fireworks sold legally in neighboring states like Indiana, Wisconsin, and Missouri. The statute exempts sparklers, snake or glow-worm pellets, smoke devices, party poppers, snappers, trick noisemakers, toy pistols, and toy caps from the consumer-fireworks definition (425 ILCS 35/1), so those novelties remain legal in Peoria. Public display fireworks are permitted only when conducted by a licensed pyrotechnic distributor or operator under the Pyrotechnic Distributor and Operator Licensing Act (225 ILCS 227/) with prior approval from the Peoria Fire Department under Peoria Code Chapter 11 and the 2018 International Fire Code Chapter 56. Importing fireworks across state lines for personal use does not create a legal-use defense β possession alone violates 425 ILCS 35/2.
A violation of the Pyrotechnic Use Act is a Class A misdemeanor (425 ILCS 35/5), punishable under Illinois law by up to 364 days in jail and a fine of up to $2,500. A second or subsequent offense within the statute can rise to a Class 4 felony for natural persons or a business offense punishable by a $10,000 fine for corporations. Peoria Police and the Peoria Fire Department additionally issue local ordinance citations under Peoria Code Chapter 11, typically in the $100-$750 range, with seizure and destruction of the fireworks. Fires, injuries, or property damage caused by illegal fireworks can result in civil liability and additional criminal reckless-conduct charges (720 ILCS 5/12-5).
