Consumer fireworks are legal in unincorporated Hillsborough County on the three state-designated holidays only: July 4, December 31, and January 1. Outside those dates, only sparklers and novelties from the approved list may be used. Agricultural exemption use has been narrowed by the 2020 Fireworks Law.
Florida Statute 791.08 preempts local bans on consumer fireworks on the three designated holidays, and Hillsborough County enforces the state framework. Discharge is prohibited on public property, county parks, and beaches at any time. Sellers must hold a seasonal permit and comply with NFPA 1124. Large burn bans issued by the Board of County Commissioners can suspend discharge except as preserved by state law.
Unlawful discharge outside designated days: civil citation up to 500 dollars. Reckless use causing injury or fire: criminal referral under FL 791.06 and 806.13.
