Following Georgia's 2015 legalization of consumer fireworks, Roswell adopted Article 10.16 to limit when and where they can be used. Permitted hours are 10 a.m.-9 p.m. on standard days; the window extends to midnight on New Year's Eve, July 3, July 4, and December 31, and from midnight to 1 a.m. on January 1. Use is prohibited on the property of others without consent, in any city park, historic site, or recreational area, and within 100 yards of a gas station, water treatment plant, or facility that refines or stores flammable liquids or gases. A Special Use Permit ($100 fee, applied for at least 15 days in advance, approved by the City Administrator) is required to ignite consumer fireworks outside the allowed hours.
Violations of Art. 10.16 are prosecuted in Roswell Municipal Court with fines up to $1,000 and/or six months in jail under the city's general penalty clause. The Fire Marshal can also seize illegal aerial display devices.
