Within the City of Schenectady, sparkling devices may be used on private property with the property owner's permission. Use on public sidewalks, streets, parks, and school grounds is prohibited. Users must be 18 or older. All other types of fireworks β anything that explodes, shoots into the air, or makes a loud report β remain illegal year-round and may be seized on sight.
The Schenectady Fire Department and Police Department conduct active enforcement during July 4 and New Year's weekends. Complaints from neighbors are the most common trigger; police respond, confiscate fireworks, and may issue appearance tickets. Fires caused by illegal fireworks are investigated by the Fire Marshal and may result in restitution as well as criminal charges.
Possession of illegal fireworks is a Class B misdemeanor under PEN Β§270.00, punishable by up to 90 days in jail and a $500 fine. Sale of illegal fireworks is a Class A misdemeanor (up to one year in jail). Igniting fireworks that cause property damage or injury can result in additional reckless endangerment or arson charges plus civil liability for damages.
