The Kansas Fireworks Act (K.S.A. 31-501 et seq.), administered by the State Fire Marshal, makes consumer fireworks legal statewide and licenses the sellers and seasonal stands. Local governments set the discharge calendar, and they differ sharply here. In the City of Topeka, discharge is lawful only on July 3 from 10 a.m. to 11 p.m. and July 4 from 10 a.m. to 11:59 p.m., and never within 500 feet of the Colmery-O'Neil VA Medical Center on SW Gage Boulevard. In unincorporated Shawnee County, Home Rule Resolution 2006-11 permits discharge June 27 through July 4, 8 a.m. to midnight.
In Topeka, discharging outside the two permitted days is a misdemeanor punishable by a $250 to $499 fine and up to 179 days in jail.
