Florida law (FS 791.08) lets you use consumer fireworks on three designated holidays: New Year's Eve, New Year's Day, and July 4. Lake County cannot ban them on those days. Otherwise, only sparklers and approved novelties are legal.
Since 2020, Florida Statute 791.08 makes it lawful to use consumer fireworks on New Year's Day (Jan 1), Independence Day (July 4), and New Year's Eve (Dec 31). Local governments and HOAs may regulate fireworks generally but cannot abrogate the right to use them on those three designated holidays. Outside those dates, FS 791.02 makes it unlawful to use or explode fireworks; only sparklers and approved novelties bought from a registered seller are permitted. Public displays require a county permit applied for at least 15 days in advance. A countywide drought burn ban does not override the three statutory holidays.
Using fireworks outside the three designated holidays can be charged as a first-degree misdemeanor under FS 791.06. Local law enforcement and fire officials respond to complaints.
