Suffolk bans consumer fireworks. Under City Code Sec. 38-142, it is unlawful to sell, use, or explode any fireworks, including sparklers and fountains, except at supervised public displays permitted by the Fire Marshal.
Suffolk goes beyond Virginia's statewide rule. State law (VA Code Sec. 27-95 et seq.) allows only non-aerial, non-explosive 'permissible fireworks' such as sparklers and fountains and lets localities restrict further. Suffolk's Fire Code, Article V (Sec. 38-141 through 38-144, readopted by Ord. No. 25-O-049 in 2025), defines fireworks broadly to include sparklers, firecrackers, Roman candles, and skyrockets, and prohibits their sale, storage, use, or discharge unless part of a supervised public display approved by the Fire Marshal. Only auto flares and paper caps are exempt. Display operators must apply through Parks and Recreation at least 30 days ahead.
Selling, possessing, or discharging fireworks outside a permitted display is a misdemeanor; the Fire Marshal may seize and remove all fireworks at the owner's expense. General penalties reach up to $2,500 and 12 months in jail.
