Full Breakdown
MGL c.148 §39 bans the sale, possession, and use of all fireworks across Massachusetts, so no Plymouth County town, Brockton, Plymouth, Wareham, Middleborough or any other, permits them. The statute's definition of fireworks explicitly includes firecrackers, cherry bombs, M-80's, Roman candles, sky-rockets, and sparklers. Devices legal in New Hampshire remain illegal once brought into the commonwealth. Only supervised displays licensed by the State Fire Marshal under §39A are lawful. Police may seize fireworks without a warrant, and they are forfeited to the commonwealth on conviction.
Violations & Fines
Possession or use is punished by a fine of not less than ten dollars nor more than one hundred dollars, plus seizure and forfeiture. Selling fireworks: $100 to $1,000 and up to one year imprisonment.
