Outdoor burning rules in Auburn, AL β also called the burn ban, open burning, or fire restriction ordinance β set when you can burn yard waste, debris, or run a recreational fire.
Open burning of natural vegetation and untreated wood is allowed in Auburn only with a free burn permit and a fire-department site inspection. Burning is restricted to 8 a.m.-3 p.m., must be 500 ft from occupied dwellings, attended at all times, and is banned during drought, rain, or overcast conditions. Prohibited materials include plastics, rubber, garbage, and treated wood.
The City of Auburn Fire Department issues free open-burning permits after a required on-site inspection that sets the approved location and distances. Permitted burns may only burn natural vegetation and untreated wood; the Auburn page lists prohibited materials as heavy oils, asphalt, plastics, vinyl, insulation, paper, cardboard, rubber, chemicals, garbage, treated/painted wood, and trash. Burning is allowed only between 8:00 a.m. and 3:00 p.m., with no material added to the fire after 3:00 p.m., and the fire must be continuously attended and completely extinguished by the end of each day. No burning is permitted during overcast periods, rain, extremely dry conditions, or drought. The location must be at least 500 feet from the nearest occupied dwelling other than the one on the burning property. Permits are free and valid for 30 days; schedule an inspection at 334-501-3231, ext. 4. Statewide, the Alabama Forestry Commission administers the forest-fire burn law (Ala. Code 9-13-11): persons burning within or near forest/woodland must clear inflammable material a safe distance in all directions, stay with and control the fire, and have adequate tools and manpower; the State Forester may declare a Fire Alert that restricts or suspends burning during high fire danger. ADEM Rule 335-3-3-.01 also separately governs open burning for air-quality purposes.
The Auburn Fire Department may impose additional conditions or order extinguishment of unpermitted or hazardous fires. Under Alabama Forestry Commission burn law (Ala. Code 9-13-11), burning without proper precautions is a Class B misdemeanor, reckless burning that escapes onto another's land is a Class A misdemeanor, and willful burning of another's woodland is a Class C felony.
