Sec. 8-9 sits in the fire prevention and protection chapter and gives the fire chief, not code enforcement or the police department, sole discretion over open-burning permission inside Warner Robins city limits. The ordinance covers any burning of refuse or trash, a broad category that reaches yard debris, construction waste and household trash alike; it doesn't carve out exceptions for agricultural burns, recreational fires or storm-cleanup debris. Permission is conditional rather than automatic: the fire chief may allow burning only where no laws or ordinances will be violated and the public health and safety will not be endangered, which lets the chief weigh factors like wind conditions, proximity to structures, smoke and any active state burn restriction before granting approval.

The same fire chapter separately bans keeping more than five gallons of gasoline or other highly volatile combustible liquids at a residence outside a metal safety container under Sec. 8-6, and makes creating or failing to eliminate a fire hazard a misdemeanor in its own right under Sec. 8-7, so an unauthorized burn that also creates a hazard can draw more than one citation.
