The City of Antioch enforces California state requirements for smoke alarms and carbon monoxide (CO) detectors in all residential dwellings. Under California Health and Safety Code 13113.7 and 13113.8, working smoke alarms must be installed inside every sleeping room, outside each separate sleeping area in the immediate vicinity of bedrooms, and on every story of the dwelling including basements. Since July 1, 2014, any replacement or new-install battery-only smoke alarm must be a 10-year sealed-battery unit certified by the State Fire Marshal. Hardwired alarms with battery backup are required in new construction and substantial remodels under the California Building Code. Carbon monoxide detectors are required under Health and Safety Code 13260-13263 in any dwelling with an attached garage, fuel-burning appliance, or fireplace; placement mirrors smoke-alarm locations. At time of sale, the seller must certify compliance on the Transfer Disclosure Statement (TDS), and at rental turnover the landlord is responsible for installation and testing; tenants must maintain batteries during occupancy. Antioch building inspectors verify compliance during any permitted work. Non-functioning alarms found during fire incident investigations by CCCFPD can result in citations up to $200, and non-compliance is a factor in civil liability if injury occurs.
