Antioch is one of the few Contra Costa County cities that ALLOWS the sale and use of State Fire Marshal-approved Safe and Sane fireworks from July 1 through July 4 each year. All other fireworks, including skyrockets, firecrackers, and aerials, remain illegal and can trigger $1,000+ fines under AMC Chapter 5-5.
Unlike most cities in Contra Costa County where all consumer fireworks are banned, the City of Antioch permits the sale and discharge of California State Fire Marshal-approved Safe and Sane fireworks during a limited window each year, making it one of only a handful of legal-fireworks cities in the Bay Area along with Pacheco and Bay Point (unincorporated). Under Antioch Municipal Code Chapter 5-5 (Fireworks) and Ordinance 2009-03, nonprofit organizations may apply for retail sales permits to operate temporary fireworks stands from noon on June 28 through noon on July 6, with actual sales conducted from June 28 to July 4. Public discharge of Safe and Sane fireworks by residents is lawful only from 9:00 AM on July 1 through 10:00 PM on July 4 within city limits. Safe and Sane items include ground-based fountains, sparklers, and snakes bearing the State Fire Marshal seal; they do not leave the ground or explode. All aerial fireworks, firecrackers, M-80s, bottle rockets, Roman candles, and skyrockets remain strictly illegal at all times under California Health and Safety Code 12500+ and city ordinance. Violations carry administrative fines up to $1,000 plus potential misdemeanor prosecution, and CCCFPD has used 'zero tolerance' enforcement with social host liability. Possession in city parks and schools is always prohibited. During Red Flag Warning conditions the Fire Marshal may suspend even Safe and Sane privileges.
