Brentwood is one of the few Contra Costa cities that allows State Fire Marshal approved "Safe and Sane" fireworks. Sales and discharge are permitted only from noon June 28 through 10 PM July 4, and only from licensed nonprofit stands. All aerial, explosive, or out-of-state fireworks remain illegal under Health & Safety Code Section 12500 et seq.
Brentwood Municipal Code authorizes the sale and use of "Safe and Sane" fireworks bearing the California State Fire Marshal seal during a narrow Independence Day window. Licensed nonprofit organizations may operate approved booths after obtaining a city permit, and proceeds must benefit a local cause. Discharge is restricted to private property with the owner's consent and is prohibited on all public streets, sidewalks, parks, and school grounds. Aerial fireworks, firecrackers, sky rockets, Roman candles, and any device not bearing the Safe and Sane seal are illegal statewide and carry fines up to $1,000 per violation under California Health and Safety Code Section 12700. Importation of fireworks from Nevada or other states is a misdemeanor. During Red Flag Warnings the East Contra Costa Fire Protection District and City Council may suspend use even during the legal window. Hosts of discharge activity are responsible for cleanup and for any fire damage caused. Unattended minors may not purchase or discharge fireworks.
