Summary

Louisiana law, not a Jefferson Parish ordinance, sets the state's smoke and carbon monoxide detector floor: any one- or two-family home sold or leased anywhere in the parish must have at least a working ten-year sealed-battery smoke detector and a sealed-battery carbon monoxide detector at the time of the transaction. La. R.S. 40:1581 extends the same carbon monoxide requirement to anyone installing a home generator, but also says noncompliance can't hold up the sale or void an insurance claim.

These county ordinances apply to unincorporated areas of Jefferson Parish. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

§1581. Smoke detectors; carbon monoxide detectors; one- or two-family dwellings. A. All existing one- or two-family dwellings at the time of sale or lease shall contain, at a minimum, an operable ten-year, sealed lithium battery smoke detector. B. All existing one- or two-family dwellings at the time of sale or lease shall contain, at a minimum, an operable carbon monoxide detector with a long-life, sealed battery. The carbon monoxide detector may be combined with smoke detection. C. Professional installers who install generators in one- or two-family dwellings shall include with installation of a home generator, at minimum, an operable carbon monoxide detector with a long-life, sealed battery. D. Failure to comply with the provisions of this Section shall not be a reason for nonpayment of any insurance claims. E. Failure to comply with the provisions of this Section shall not cause a delay or a stoppage in the transfer of the property. F. The real estate agent shall not be liable for the seller's failure to comply with the provisions of this Section.

Full Breakdown

Jefferson Parish's own code doesn't set a general smoke-detector rule for existing single-family and two-family homes; that requirement comes from state law, La. S. 40:1581, which applies uniformly across the parish and every other Louisiana jurisdiction. Subsection A requires every existing one- or two-family dwelling, at the time it's sold or leased, to have at minimum an operable ten-year, sealed lithium-battery smoke detector, the type designed to run for a decade without a battery swap rather than a standard 9-volt unit. Subsection B adds a parallel carbon monoxide detector requirement, also with a long-life sealed battery, and the statute lets a single combination unit satisfy both the smoke and carbon monoxide detector rule at once.

Subsection C extends the carbon monoxide piece specifically to professional installers: anyone who installs a home generator in a one- or two-family dwelling has to include an operable carbon monoxide detector with the generator installation, recognizing that portable and standby generators are a leading cause of accidental carbon monoxide poisoning after storms knock out power, a recurring event in a hurricane-prone parish like Jefferson. The statute is deliberately light on enforcement teeth: subsections D through F make clear that failing to have the detectors installed is not grounds to withhold an insurance claim, cannot delay or stop a real estate closing, and doesn't expose the real estate agent handling the sale to liability for the seller's noncompliance. 5-2, which is actively inspected before a lodging license issues.

Violations & Fines

La. R.S. 40:1581 doesn't set a fine or criminal penalty for skipping the detector requirement. Subsections D and E specifically bar using noncompliance as a reason to deny an insurance claim or to delay or stop a property sale, and subsection F shields the real estate agent from liability for the seller's failure to install the required equipment. The practical consequence falls on the buyer or tenant, who may move into a home lacking a legally required smoke or carbon monoxide detector with no separate parish citation attached to that specific gap.

Frequently Asked Questions

Does Jefferson Parish require smoke detectors in every home?
The specific mandate comes from state law, not a parish ordinance. La. R.S. 40:1581 requires every existing one- or two-family dwelling to have a working ten-year sealed-battery smoke detector at the time it's sold or leased, and that statute applies the same way in Jefferson Parish as anywhere else in Louisiana. Jefferson Parish's own detector rule only applies specifically to short-term rentals and other lodging accommodations.
What kind of carbon monoxide detector does the law require?
Subsection B of La. R.S. 40:1581 requires an operable carbon monoxide detector with a long-life sealed battery in every one- or two-family home at the time of sale or lease, and it allows a single combination unit to cover both the smoke and carbon monoxide requirement. Anyone installing a home generator in such a dwelling has to add a carbon monoxide detector as part of that installation under subsection C.
Can a home sale fall through because the detectors are missing?
No. Subsections D and E of the statute specifically say a missing detector can't be used to deny an insurance claim or to delay or stop the transfer of the property, and subsection F protects the real estate agent from liability if the seller never installed the required equipment. The statute sets the requirement without attaching a sale-blocking enforcement mechanism to it.
