Allen County Code 8-16-3 requires that all family dwelling units in the county have a minimum of one functional, properly located, labeled and listed smoke detector meeting NFPA Standard 74. Section 8-16-4-1 directs that, absent manufacturer instructions, the detector protect sleeping areas, located outside bedrooms but within 15 feet of all sleeping rooms, and 8-16-4-2 sets ceiling/wall placement (6-12 inches from the ceiling, no recessing). Tampering with or removing a detector is unlawful (8-16-5). Statewide, IC 22-11-18-3.5 makes landlords responsible for installing and, within seven working days of written notice, repairing detectors in rental dwellings.
Tampering with a required detector violates AC 8-16-5. A landlord who fails to provide a required rental smoke detector commits a Class B infraction (Class A on repeat) under IC 22-11-18-3.5.
