Louisiana law requires every one- or two-family dwelling to have a working smoke detector at sale or lease, and since 2023 a carbon monoxide detector too. Jefferson Parish enforces this statewide standard through its adopted codes; landlords must keep the alarms operable.
Under RS 40:1581, all existing one- or two-family dwellings must contain, at minimum, an operable ten-year sealed lithium-battery smoke detector at the time of sale or lease, plus (effective January 1, 2023) an operable carbon monoxide detector with a long-life sealed battery. Detectors should be located near sleeping areas per manufacturer and code guidance. In rentals the landlord must install and maintain the alarms in working order; a tenant who disables one may become responsible. New construction and substantial renovations must meet the smoke-alarm provisions of the adopted building code. Non-compliance cannot delay a property transfer or void an insurance claim.
Failure to provide required detectors is a code violation; landlords may face liability, and detectors must be corrected on inspection.
