New construction and substantial alterations must use hardwired interconnected alarms with battery backup, per USBC Section R314; existing homes may rely on battery-powered alarms but the batteries must be functional. For rental dwellings, Va. Code section 55.1-1227 requires the landlord to provide working alarms at the start of each tenancy and to test/maintain them annually at the tenant's written request. Tenants may not disable or remove alarms. Carbon monoxide alarms are required in rental units with fossil-fuel burning appliances (gas furnace, gas water heater, wood stove) or an attached garage, under Va. Code section 36-99.5. Smoke alarms older than 10 years (marked on the back label) must be replaced regardless of whether they still beep. Failure to maintain detectors is a Class 1 misdemeanor for landlords and up to a $100 civil penalty for owner-occupants after written notice. The Virginia Beach Fire Department offers free smoke alarms and installation for qualifying residents through the Community Risk Reduction program.
