Since September 2021, Texas House Bill 1927 permits constitutional carry, allowing eligible adults aged 21 and older to carry handguns concealed or openly without a state-issued license. Federally prohibited persons, those with certain convictions, or under protective orders cannot carry. The optional License to Carry through Texas DPS under Government Code Chapter 411 still offers reciprocity in other states, exemptions from federal gun-free school zones, and streamlined purchasing. Austin cannot impose additional permit requirements. Private property owners may post Sec. 30.06 (concealed) or 30.07 (open) signs prohibiting carry on premises. Carry remains illegal in courthouses, polling places, schools, and bars selling 51 percent alcohol.
Carrying in prohibited locations or by ineligible persons is a Class A misdemeanor or felony under Texas Penal Code Section 46.035, with fines up to $4,000 and jail up to one year.
