Full Breakdown
01 as any food preparation establishment capable of being readily moved from location to location without a fixed address, which covers food trucks and trailers. 02(D) requires the operator to obtain a permit from the County Health Officer before operating, and to post that permit in a conspicuous place. 02(H) sets the mobile-unit annual fee at $25, but carves out an exception: if the same operator already holds a valid permit for a permanent or temporary food preparation establishment, the mobile unit does not need its own separate permit, so long as the permit number of that fixed or temporary establishment is conspicuously displayed on the side of the truck in a manner the County Health Officer prescribes.
C. 02(M) doubles the fee for anyone who begins operating before securing the required permit. 02(L); a new owner or a relocated unit must obtain a fresh permit and pay the fee again, with no refund for the unexpired term of the old one.
Violations & Fines
Operating a mobile food unit without the required Health Department permit, or without displaying the linked permit number when relying on the exemption, is punishable under § 112.99: a first offense draws a fine of $10 to $50 and a second or later offense draws $50 to $300. Separately, § 112.02(M) doubles the permit fee for anyone caught operating before securing a permit, and § 112.99(B) adds a $100-per-day fine once the Health Department has given 30 days' written notice of the violation.
