Summary

A food truck operating in unincorporated Lake County needs a permit from the Lake County Health Department before serving a single meal, and the annual mobile-unit fee is $25. If the owner already holds a permit for a fixed or temporary location, the truck itself is exempt as long as that permit number is posted on the vehicle.

These county ordinances apply to unincorporated areas of Lake County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(D) Permit; obtaining and posting. Any person, before operating a food preparation establishment with a permanent location in Lake County, a temporary food preparation establishment, a mobile food preparation establishment of a grocery shall secure a permit to operate such a respective establishment from the County Health Officer. The permit shall be posted in a conspicuous place in the establishment... (H) Mobile food preparation establishment. With any application for permit for a mobile food preparation establishment, the applicant shall pay to the Lake County Health Department an annual fee of $25 provided however, that if the mobile food preparation establishment operates a permanent or temporary preparation establishment with a valid permit, the mobile unit shall not be required to have a permit provided further that the permit number of the respective permanent or temporary food preparation establishment be conspicuously displayed on the side of each mobile unit in a manner prescribed by the County Health Officer.

Full Breakdown

01 as any food preparation establishment capable of being readily moved from location to location without a fixed address, which covers food trucks and trailers. 02(D) requires the operator to obtain a permit from the County Health Officer before operating, and to post that permit in a conspicuous place. 02(H) sets the mobile-unit annual fee at $25, but carves out an exception: if the same operator already holds a valid permit for a permanent or temporary food preparation establishment, the mobile unit does not need its own separate permit, so long as the permit number of that fixed or temporary establishment is conspicuously displayed on the side of the truck in a manner the County Health Officer prescribes.

C. 02(M) doubles the fee for anyone who begins operating before securing the required permit. 02(L); a new owner or a relocated unit must obtain a fresh permit and pay the fee again, with no refund for the unexpired term of the old one.

Violations & Fines

Operating a mobile food unit without the required Health Department permit, or without displaying the linked permit number when relying on the exemption, is punishable under § 112.99: a first offense draws a fine of $10 to $50 and a second or later offense draws $50 to $300. Separately, § 112.02(M) doubles the permit fee for anyone caught operating before securing a permit, and § 112.99(B) adds a $100-per-day fine once the Health Department has given 30 days' written notice of the violation.

Frequently Asked Questions

Does a food truck need its own permit in unincorporated Lake County?
Yes, unless it is linked to a permit the same operator already holds for a permanent or temporary food establishment. Section 112.02(D) requires a Health Department permit before operating, and § 112.02(H) sets a $25 annual fee for a standalone mobile unit.
How is a food truck exempt from paying its own permit fee?
Section 112.02(H) waives the separate mobile-unit fee if the operator already has a valid permit for a permanent or temporary food preparation establishment, provided that permit's number is conspicuously displayed on the side of the truck in the manner the County Health Officer prescribes.
What happens if I operate a food truck before getting a Lake County permit?
Section 112.02(M) requires you to pay double the regular permit fee once you comply with the chapter's other requirements. Section 112.99 adds fines of $10 to $50 for a first offense and $100 per day after a 30-day written notice if the permit is still missing.
