005 as anyone selling food or merchandise from a pushcart, display, cart, wagon or similar nonmotorized conveyance on a public sidewalk, to first obtain a zoning certification permit from the planning division, with a separate permit needed for each vendor. Under subsection B, the application must include the vendor's name and address, a description of what is sold, a California seller's permit number if applicable, any required health department food permit, and the name of any principal the vendor represents. Subsection C imposes operating standards: the vendor must keep at least a four-foot clear path of travel free of tents, chairs, signage or other obstacles, cannot locate near an active construction zone or traffic control area, cannot vend within the immediate vicinity of a permitted farmers' market or swap meet during its operating hours, cannot vend where a temporary use, encroachment, special event or filming permit is in effect for that limited duration, and must provide a trash receptacle and keep the area clean.

010(C) separately bars vending from a vehicle on a public street within 350 feet of an in-session K-12 school. Subsection D sets graduated administrative fines rather than criminal penalties: $100, $150, then $200 for repeat non-permit violations within a year, and $250, $500, then $1,000 for vending without any permit at all, reduced by 60 percent once the vendor produces a valid permit.
