Full Breakdown
The Town of Irondequoit sets vending locations through Chapter 167, Peddling and Soliciting, not through a food truck zoning district. Section 167-12H lets a licensee work at any place in the Town of Irondequoit, with three carve-outs: property owned or leased by the Town of Irondequoit or any district thereof, property owned by any school district, and private property the owner has prohibited. Section 167-12I separately bars use of public streets or government property as standing places for vehicles, handcarts or pushcarts.
School zones are covered by § 167-12F. A licensee cannot sell or vend within 250 feet of any school property between 8:00 a.m. and 4:00 p.m. on school days. The limit runs only on school days and only during those hours.
Town property is covered by § 164-6E of the Town property chapter: public vendors and peddlers are excluded from Town property for purposes of selling or distributing any food, ice cream or beverages unless the Commissioner of Public Works or a designee authorizes it in writing.
The Fourth of July Celebration has its own rule. Section 167-13A bars any permit to a peddler, solicitor or vendor of any type for the duration of the celebration, from start to finish, for the portion of Titus Avenue from the intersection of Portland Avenue to the intersection of Kings Highway. Under § 167-13B, the license procedure does not apply to vendors selected by the July Fourth Committee.
Residential areas carry a noise-based limit in § 160-13: no person can sell anything by outcry within any area of the Town zoned for residential uses. That section does not prohibit selling by outcry of merchandise, food and beverages at licensed sporting events, parades, fairs, circuses and other similar licensed public entertainment events. Every vendor still needs the license required by § 167-3.
Violations & Fines
A violation of any provision of Chapter 167 is a misdemeanor under § 167-19, punishable as provided in § 1-16. Section 1-16B sets a fine not to exceed $1,000, imprisonment not to exceed one year, or both, plus costs of restoration, and each day an offense continues is a separate offense under § 1-16C. The Town Clerk can revoke a license for any violation under § 167-16, after consultation with the Irondequoit Police Department and Town Attorney. Appeals go to the Town Board within 14 days under § 167-17.
