Thurston County zones mobile sidewalk food and beverage vendors as a temporary use under § 23.06.060(V), the use-standards section for the Olympia urban growth area's commercial districts (arterial commercial, general commercial, neighborhood retail, community retail, professional office/residential multifamily, and medical services). Item 2(d) permits only food and beverage vendors on the sidewalk, no other merchandise, and caps the count at one mobile sidewalk vendor per block face.

The physical rules are specific: the sidewalk itself must be at least eight feet wide, the vendor's stand can be no more than three feet wide and six feet long, and it must stay on wheels so it is "readily movable at any and all times." Vendors must locate their stands at the back of the sidewalk, not blocking the pedestrian path along the storefronts, and the county grants locations on a first-come, first-served basis rather than by lottery or auction.

Every approval is temporary: it cannot run longer than ninety days, and the business license behind it does not renew automatically, so a vendor has to reapply once the ninety days run out. A permit that sits unused for thirty days after issuance becomes null and void, forcing a fresh application before the vendor can set up. Before operating, every mobile sidewalk vendor must sign a hold-harmless agreement with Thurston County, shifting liability for the roadside operation away from the county. Section 23.06.060(V)(1) requires an approved temporary use permit before any of these uses, sidewalk vending included, may begin, so a vendor cannot simply set up on a sidewalk in a qualifying commercial zone without first clearing that permit step.
