While Florida Statute 509.102 preempts local licensing of food trucks, Seminole retains authority over land use and zoning. Mobile food vendors typically operate on private property within commercial, mixed-use, and industrial zoning districts with the property owner's written consent and adequate parking, setbacks, and trash control. Operation in residential zones, on residential streets, or in public rights-of-way is generally not permitted without a special event permit. Vendors at city-sanctioned events (festivals, markets) operate under event permits issued by the city. Pinellas County parks have separate vending policies.
Operating in prohibited zones can result in zoning citations, parking violations, and orders to relocate. Repeat or willful violations escalate to higher fines and code liens.
