Full Breakdown
Sec. 28-27 is the parish code's location rule for food vendors in a parish park. Subsection (a) provides that, except as provided in subsection (b), no food or food product shall be prepared or sold within the confines of Paul Angelle Park, including, but not limited to, the pavilion. By way of illustration the prohibition includes any barbeques, seafood or crawfish boiling, or the distribution of food products by vendors. The text does not use the words food truck or mobile unit; it reaches any vendor distributing food products inside the park, so a truck parked on the park grounds is covered by the same wording as a tent or a cart.
Subsection (b) lists three exceptions. The first is consumption of any food or beverage by a member of the general public while visiting the park, so visitors can bring their own. The second is the preparation or sale of food or drink in connection with use of the park, including the pavilion, under an agreement confected under Sec. 28-26. That agreement must be approved and signed by the parish president and tied to a fund-raising or civic event sponsored by an approved organization. The third is any event within the confines of the Cecilia Civic Center.
The section marks where vending is closed, not a list of designated vending zones; the permitted vending locations it identifies are the pavilion under a Sec. 28-26 agreement and the Cecilia Civic Center. Other conditions in the same division apply to any vendor on site: Sec. 28-28 requires compliance with the parish noise ordinance in Article II of Chapter 26, and Sec. 28-29 bans glass containers anywhere in the park.
Violations & Fines
Sec. 28-30 punishes any violation of the Paul Angelle Park division with a fine of not less than $100.00 and not more than $500.00, imprisonment for not more than 30 days, or both. A violator can also be removed from the park immediately and prosecuted under other applicable state or parish law.
