Chapter 405, Peddling and Soliciting, defines peddling as 'the selling or offering for sale of any goods, wares, merchandise or service for immediate delivery upon any of the streets or sidewalks or from house to house within Upper Darby Township,' which covers a mobile food vendor working a street route. Section 405-2 makes a Department of Licenses and Inspections license mandatory before anyone may peddle or solicit on Township streets or sidewalks. Once licensed, the location where a vendor may operate is restricted: no peddling, soliciting, off-street retail sales, or sermonizing may be conducted within 75 feet of the radius curve of any street or highway intersection, or at any other spot that would obstruct the normal flow of traffic.

Vendors also cannot hawk, cry their goods, or use a loudspeaker on the streets or sidewalks while peddling. m. Separately, the Department's fee schedule lists specific vendor licenses, including one for ice cream and water ice trucks, which additionally requires the vehicle to be inspected by the Health Department. Licensees must carry their license card at all times and present it on request to a Department officer or to any person they approach while vending.
