Albemarle County, VA Garage & Yard Sales: Frequency, Duration & Permits (2026)

Albemarle County's rummage and garage sale rule lives inside its home occupation ordinance for the Rural Areas zoning district, not a standalone yard-sale law. Sec. 2A(l) lists 15 categories of use that are flatly prohibited as home occupations on rural-area properties, and item (12) puts "rummage or garage sales other than those determined by the zoning administrator to be occasional" on that prohibited list, alongside junkyards, storage yards, and commercial stables. The practical effect is a frequency test decided case by case: the Zoning Administrator, not a printed calendar cap, determines whether a given household's sales remain "occasional" and therefore exempt, or whether they have become frequent or organized enough to constitute an unpermitted home-based business, which is banned outright with no waiver available for that category of use.

This provision applies specifically to parcels in the Rural Areas zoning district; Sec. 2, the parallel home occupation ordinance covering other zoning districts, does not list garage or rummage sales among its own prohibited home occupations. A homeowner who wants certainty about how many sales the Zoning Administrator will treat as occasional, rather than relying on the case-by-case standard, needs to raise the question with Albemarle County Community Development before running recurring sales.
