Independence, MO Garage & Yard Sales: Frequency, Duration & Permits (2026)

Article 14 of Chapter 5 of the Independence City Code governs garage sales citywide. 002 sets the core frequency rule: no garage sale may be held or scheduled for more than three consecutive calendar days, and no person may conduct a garage sale more than twice in any one calendar year, nor hold a sale more than twice a year on the same premises, so the twice-a-year cap tracks both the seller and the address. 001 defines a garage sale broadly as a sale on the premises of or within any dwelling, garage, accessory building or other building, including sales conducted in a basement, patio or yard, so the rule reaches yard sales, patio sales, and basement sales alike, not just sales held in a garage.

003 bars displaying goods for sale on any public street or right-of-way, keeping merchandise off city pavement even during a lawful sale. 004 makes it unlawful to sell goods purchased for resale, goods taken in on consignment from a commercial business, or goods not accumulated in ordinary dwelling usage, so the ordinance targets true household sales rather than informal retail operations run under the garage-sale label. 005 restricts advertising: no sign may be placed in a street right-of-way or on public property, including street signs, traffic signs and utility poles, and any sign lawfully placed on private property must come down by the last day of the sale, with the person conducting the sale responsible for removing it.
