Kane County, IL Garage & Yard Sales: Frequency, Duration & Permits (2026)

Section 25-9-5-1 of the Kane County Zoning Ordinance lists every use permitted in the R1 One-Family Residential District, covering everything from single-family homes and home occupations to agriculture, dog and cat keeping, and temporary subdivision offices. Item H of that list reads simply: garage sales are limited to two per year. The county does not define how many days a single sale may run or cap the number of items offered, so the only enforceable number in the code is the count of sales allowed per property per calendar year.

Because Section 25-9-5-1 functions as the county's baseline residential-use list, several other unincorporated districts borrow it wholesale. The F District - Farming, for example, permits "the uses as permitted in the R1 District except for subsections 25-9-5-1A and P," which leaves the garage-sale cap in Section H intact. The same cross-reference pattern, adopting R1's list while excluding only the lot-size subsection and one other, appears again in the E2, E2-A and E3 Estate Districts, so a rural homeowner outside a municipality is bound by the identical two-sale ceiling as a subdivision resident in R1.

Kane County's zoning administration, which oversees Chapter 25, treats an over-the-limit sale as any other zoning violation. Section 25-4-10-1 sets the penalty: a fine of up to $500.00 for each offense, and it specifies that each week a violation goes uncorrected is a separate offense, so a sale that runs past its allotted count keeps accruing exposure. Section 25-4-10-2 additionally lets the county, or any neighbor whose property value is affected, ask the circuit court to enjoin the unlawful use outright.
